Filing for Chapter 7 Bankruptcy
For Chapter 7 bankruptcy, our San Diego bankruptcy attorneys work collaboratively with you and take an in-depth look at your current financial situation and monthly expenses. We review things like:
- Incoming money from a paycheck, unemployment benefits or welfare
- Rent charges and mortgage payments
- Car payments
- Monthly utility bills, including cell phone bills
- Credit card payments
- Personal loans
- Court-ordered expenses, such as child support or alimony
- Other expenses that contribute to your monthly payments
If you qualify for Chapter 7 bankruptcy under the means test, our attorney works with you on preparing and filing the necessary documentation for review by the bankruptcy court. Once the case is filed, you will attend a meeting of creditors (called a 341a meeting) where you will testify before the bankruptcy trustee that your information is truthful and accurate. If your documentation is in order, the bankruptcy trustee will proceed with the discharge.
Filing Chapter 13 Bankruptcy
For Chapter 13 bankruptcy, our attorneys determine how much you can afford to pay toward arrears on your debts and develop a repayment plan that reorganizes debts into one manageable monthly payment. We then notify your creditors of your intent to file. Should any creditor file an objection to the plan, our San Diego chapter 13 lawyers will negotiate with both your creditors and the bankruptcy trustee to develop a plan that works for everyone, including you.
Remember, everyone wants you to be successful in Chapter 13. Your creditors do not want to go away completely empty-handed. By filing bankruptcy, you can make good on your promises and creditors still come away with some return on their investment.
Once the court approves the plan, you will be responsible for making monthly payments for the set time (usually three to five years) to the bankruptcy trustee, who will distribute it evenly to all creditors named in the plan.
