What is Chapter 13 Bankruptcy

Chapter 13 bankruptcy gives people who do not qualify for Chapter 7 bankruptcy the opportunity to obtain debt relief through debt reorganization. Instead of discharging debts right away, it reorganizes them into a payment plan to be paid over three to five years. Once complete, all remaining qualified unsecured debts in the plan are discharged.

A Chapter 13 bankruptcy claim will incorporate debts like:

  • Medical bills
  • Vehicle loans
  • Credit card debt
  • Certain student loans
  • Personal loans
  • Homeowners' association fees

You can also include past due domestic orders, such as child support, and certain back-due taxes in your plan, but they must be paid back in full by the completion of the plan.

You will still be responsible for all normal monthly bills, such as your mortgage payment, car payment and utility bills. However, you will only need to make one monthly payment to your bankruptcy trustee, who will disperse it among all creditors in the plan.
